JUSTICE S.TALAPATRA The instant application is filed by the convict appellant-petitioner for suspension of sentence dated 30.07.2015 passed by the learned Addl. Sessions Judge, Unakoti Judicial District, Kamalpur, in Case No. S.T.(NT/KMP) 59 of 2012 wherein, the petitioner was convicted under Section 376 of the IPC and sentenced him to suffer RI for 7 years with a fine of Rs. 10,000/-, in default to suffer further RI for 3 months and also to pay a fine of Rs. 500/- under Section 342 of IPC.

Heard the learned counsel appearing for the parties and also perused the impugned judgment and the appeal being Crl. A(j). No. 46 of 2015. According to us, it is not a fit case where the order of sentence should be suspended. Accordingly, the prayer for suspension of sentence is rejected.
