JUSTICE S.TALAPATRA The instant application is filed for condoning the delay of 175 days in preferring the appeal against the judgment of conviction and sentence dated 30.01.2015 passed by the learned Addl. Sessions Judge, Khowai, West Tripura, in Case No. S.T. 09(WT/K) of 2011, wherein, the convict petitioner was convicted under Section 302 of the IPC and sentenced him to undergo imprisonment for life.

Heard Ms. P. Ghatak, learned counsel appearing for the applicant and Mr. A. Ghosh, learned P.P. appearing for the State respondent. Mr. Ghosh, learned P.P. fairly submits that he has no objection to the prayer for condoning the delay, as the matter is relating to the conviction under Section 302 of the IPC. We are of the considered opinion that this is a fit case where the delay should be condoned. Accordingly, the delay of 175 days in preferring the appeal is condoned. The I.A. is disposed of.
