This is an application filed under Section 5 of the Limitation Act for condoning the delay of 109 days in preferring the appeal under Section 374(2) of the Cr.P.C. against the judgment and order dated 17.07.2014 delivered in S.T.57(NT/D) of 2013 by the Additional Sessions Judge, North Tripura, Dharmanagar.

The causes as assigned in this application constitute sufficient cause for condoning the delay.

Mr. Deb, learned counsel appearing for the State does not oppose the prayer. Accordingly, the delay is condoned and as corollary thereto, this petition stands allowed. The appellant-applicant is permitted to present the connected appeal. The CM. application is disposed of.
