Bhowmik for the respondent-petitioner and learned counsel Mr. D.C. Nath for the O.P.-appellants. By filing this petition, the respondent-petitioner prayed for directing the O.P.- appellants to deposit 50% of the awarded amount of compensation since the appeal is pending from the year 2013.

On perusal of the judgment passed by the tribunal, I find that the tribunal has awarded an amount of Rs.2,45,780/- while disposing the claim petition. The operation of the judgment and award has been stayed when the appeal was admitted by this Court. No order for payment was made at that time as there was no such prayer. Since it is a case of compensation and since the tribunal has awarded an amount of Rs.2,45,780/-, the O.P.- appellants are directed to pay an amount of Rs.1,00,000/- (Rupees one lakh) pending disposal of the appeal. The amount should be deposited in the Registry of this Court in connection with this case within 45 days from today. The CM application accordingly stands disposed of.
