Heard Mr. R. Paul, the learned legal aid counsel appearing for the petitioner and Mr. G.S. Bhattacharjee, the learned State Counsel appearing for the respondents. This writ petition is directed against the refusal of the respondent No.3 to furnish a copy of the inquiry report made against the petitioner.
It may be recalled that following the conviction of the petitioner in Criminal Appeal No.05/2012, the petitioner was dismissed from service by the State-respondents in exercise of the powers conferred under Article 311(2)(a) of the Constitution of India. The dismissal of the petitioner has now been upheld by the Apex Court in Criminal Appeal No.1200 of 2015 [Arising out of SLP(Crl.) No.7237 of 2015]. Under the aforesaid circumstances, no useful purpose will be served by directing the respondent No.3 to supply copy of the inquiry report to the petitioner.
This writ petition is, therefore, devoid of merit and is, accordingly, dismissed.
