SAHA The instant application is filed by the applicants legal heirs of the deceased appellant for condoning the delay of 26 days in preferring the application for substituting them as appellants in the Memo of Appeal.

Heard learned counsel for the parties and also has gone through the reasons for delay in preferring the substitution application.

According to this Court the delay has been properly explained and the same is satisfactory. More so, Mr. Acharji, learned counsel, appearing for the respondents submit that he has no objection to the prayer for condonation of delay. In view of the above, delay of 26 days is hereby condoned.
