This is a petition under Section 24 read with Section 151 of the CPC for transferring the case being Money Suit No.37 of 2013 from the Court of the Civil Judge Sr. Divn., Court No.1, Agartala, West Tripura to the Court of the Civil Judge, Sr. Divn., Dharmanagar, North Tripura.

Mr. Chakraborty, learned counsel appearing for the petitioner has submitted that in the Court of the Civil Judge, Sr. Divn., Dharmanagar, North Tripura another suit being TS 15 of 2012 instituted by the petitioner is pending out of the same subject matter and between the same parties.

Mr. Nandi, learned counsel appearing for the respondents has submitted that he has instruction to submit that the respondents have no opposition if such transfer is directed by this Court.

Having regard to this consensus between the parties, there cannot be any impediment to transfer the said Money Suit No.37 of 2013 from the Court of the Civil Judge Sr. Divn., Court No.1, Agartala, West Tripura to the Court of the Civil Judge, Sr. Divn., Dharmanagar, North Tripura.

Accordingly, it is ordered.

The Civil Judge, Sr. Divn., Court No.1, Agartala, West Tripura is directed to transmit the case record of Money Suit No.37 of 2013 so that it reaches the Court of the Civil Judge, Sr. Divn., Dharmanagar, North Tripura latest by 02.05.2015. A copy of this order be transmitted to the Court of the Civil Judge Sr. Divn., Court No.1, Agartala, West Tripura in the course of the day. Accordingly, this petition stands allowed and disposed of.
