JUSTICE S.C.DAS This is a petition under Section 439 of Cr.P.C., praying for bail of the accused-petitioners Smt. Gouri Bhowmik and Smt. Manju Bhowmik who are in custody since 07.01.2015 in connection with R.K. Pur Women P.S. Case No.143 of 2014, registered under Section 498-A, 302 & 120-B of IPC.

Heard learned counsel Mr. S. Lodh for the accused-petitioners and learned Addl. P.P. Mr. R.C. Debnath for the State-respondent.

Learned Addl. P.P. produced the case diary and fairly submits that there is evidence of exercise of cruelty by both the accused-petitioners on the deceased Kakali Shib. It is submitted by Mr. Lodh, learned counsel for the accused-petitioners that the accused-petitioners along with others moved this Court an application under Section 438 of Cr.P.C. which was registered as AB No.192 of 2014 and by order dated 18.12.2014 this Court granted anticipatory bail to two of the accused-petitioners and the application of the present accused-petitioners were rejected on the ground that there were some evidence collected against them on the allegation of exercise of cruelty against the deceased Kakali Shib. A copy of that order dated 18.12.2014 passed in AB No. 192 of 2014 is annexed as Annexure P/3.

The allegation of murder is only against the husband of the deceased namely Sri Kamal Bhowmik. The accused-petitioners are in custody from 07.01.2015. So, considering that they are women and are in custody from 07.01.2015 and considering the gravity of the allegation against them, their bail prayer is allowed. The accused-petitioners Smt. Gouri Bhowmik and Smt. Manju Bhowmik be released on bail on their furnishing a bail bond of Rs.10,000/- (Rupees ten thousand) with one surety of like amount to the satisfaction of the Chief Judicial Magistrate, Gomati, Udaipur on condition that they should keep themselves available before I.O. as and when required and they should not interfere in the investigation or influence the witnesses in any manner.

Bail application accordingly stands disposed of. Send a copy of this order to the Court of learned Chief Judicial Magistrate, Gomati, Udaipur.

Case diary is returned to learned Addl. P.P.
