JUSTICE S.TALAPATRA Seen the reply filed by Mr. Suman Bhattacharya, learned Advocate, dated 25.02.2015. This court is not at all satisfied with this reply. However, in exercise of the leniency, this court is inclined to close the matter now. But, in future it is cautioned that Mr. Bhattacharya, learned counsel whenever is appointed as the legal aid counsel shall exercise due diligence. If he finds any difficulty in preparing the memorandum of appeal, he should inform the matter to the High Court Legal Services Committee immediately or return the brief to them for taking the appropriate arrangement. Ghosh, learned Public Prosecutor appearing for the state. Having regard to the causes as assigned in this petition, this court is satisfied that the petitioner cannot be blamed for the delay. As such this court is inclined to condone the delay in presenting the appeal against the judgment of conviction and order of sentence dated 04.10.2012 delivered in Sessions Trial No.14(NT/KMP)/2012 by the Addl. Sessions Judge, North Tripura District, Kamalpur.
Since the delay has been condoned, this petition stands allowed and accordingly disposed of.
