Pal, learned counsel appearing for the respondents has submitted that by the notification dated 06.10.2009 published in the Tripura Gazette dated 13.10.2009 in exercise of the power conferred by Rule 4 of the Tripura Employees Insurance Court Rules, 2008 the State Government has appointed District and Sessions Judge, West Tripura District to preside over the West Tripura District Employees Insurance Court. The matter relates to the dispute which squarely falls within the provisions of Tripura State Insurance Act, 1984 and is to be adjudicated at the first instance by the District Employees Insurance Court. As existence of such court, was not within the knowledge of the petitioner, the petitioner had approached this Court.
Mr. A. K. Bhowmik, learned senior counsel appearing along with Ms. A. Banik, learned counsel submits that the petitioner may be granted six weeks time to approach the said court for redressal of his grievance.
The said prayer is allowed.
The petitioner may file the appropriate petition before the said court within six weeks from today. If such petition is filed within such time that has to be treated as filed within limitation, if any.
A copy of this order be furnished to the learned counsel appearing for the parties in the course of the day.
In the meanwhile the impugned order shall not be given any effect. But on expiry of that six weeks from today, this interim order will have no effect whatsoever. Accordingly, this petition stands disposed of. No order as to costs. Download Date: 8-05-2017 15:05 1/1
