JUSTICE S.C.DAS Heard learned counsel Mr. Janardhan Bhattacharji for the accused-petitioner and learned Addl. P.P., Mr. R.C.Debnath for the State-respondent. This is an application under Section 438 of Cr.P.C. praying for bail of accusedpetitioner Gita Natta (Goswami) in connection with Airport P.S. Case No.82/14 which has been renumbered as Special (NDPS) Case No.29/14, registered under section 22(C),25 and 29 of NDPS Act.

A similar bail application, of this accused-petitioner, vide AB No.174/14 was rejected by this Court with a speaking order on 25.11.2014. Learned counsel Mr. Bhattacharji with all his fairness has submitted that investigation is almost complete and at this stage, the accused-petitioner who is a widowed lady, may be released on pre-arrest bail. There is no chance of her absconsion or tampering of evidence of this case.

Since this is a case under NDPS Act and earlier bail application has already been rejected after considering the materials in the case diary, I find no justification at all to consider the bail application of this accused-petitioner on similar ground. Hence, bail application stands rejected.
