I.A. 01 of 2017 In LA App 38 of 2011 B E F O R E THE HON'BLE MR. JUSTICE S.TALAPATRA 12.01.2018 Heard Mr. SS Debnath, learned counsel appearing for the referring-claimant-petitioner as well as Mr. H. Deb, learned ASG appearing for the appellantrespondents. The appellant-respondents have deposited the amount which has been enhanced by the judgment and decree passed by the Land Acquisition Judge and as affirmed by this court in the appeal. Now, by this petition the referring-claimant-petitioner prays for leave for allowing him to withdraw the deposited sum.

As there is no embargo in disbursing the said deposit to the referring-claimant-petitioner, the Registry is directed to transfer the deposited amount to the referring-claimant-petitioner following the due process. Accordingly, this application stands allowed and disposed of.
