SAHA The instant application is filed by the applicants for staying the operation of the impugned judgment and award dated 25.06.2013 in case No. Misc. LA 34 of 2010 passed by the learned LA Judge, South Tripura, Udaipur wherein the learned LA Judge enhanced the award passed by the learned LA Collector.

Mr. B. Dutta, learned counsel appearing for the applicants submits that when the appeal is admitted it would be proper for the Court to stay the impugned judgment and award till the disposal of the LA Appeal No. 14 of 2014.

Mr. SM Chakraborty, learned senior counsel appearing for the respondents in his usual fairness submits that he has no objection to the prayer for stay subject to deposit of 50% of the enhanced awarded amount.

In view of the above, the impugned judgment and award dated 25.06.2013 shall remain stayed till the disposal of the connected appeal subject to deposit of 50% of the enhanced awarded amount within a period of 3 (three) months from today. It is made clear that if the enhanced awarded amount, as ordered, by this Court is not deposited within the stipulated period, as mentioned, then the stay order granted by this Court will automatically vacate.
