SAHA There is a delay of 244 days in filing the appeal. In the application for condonation of delay, the applicant-appellants have only set out the movement of the file from one day to another but virtually there is no explanation why the file remained pending with one official for so many days. Authorities like the Food Corporation of India must know that the limitation for filing appeal is 30 days but despite this in some cases an official has not dealt with the file for 25/30 days at a stretch. The officials must realise that they have to move with alacrity when dealing with Court cases. Mr. R Dutta, learned counsel for the respondent has strenuously objected to the petition for condonation of delay.

However, since larger public interest is involved, we condone the delay in filing the writ appeal subject to payment of Rs.5,000/- as costs. Costs be deposited with the Tripura Bar Council within four weeks from today.

List the matter (WA 06/2015) for admission on 18th June, 2015. We have been informed at the Bar that some contempt petition has been filed. This order may be placed before the learned single Bench and we request the learned single Judge not to dispose of the contempt petition. Learned single Judge may proceed with the contempt petition but shall not pass final order(s) till the appeal is disposed of. CM Application is accordingly disposed of.
