SAHA The instant appeal has been filed by the petitioner for setting aside the order dated 24.02.2015 passed in WP(C) No. 62/2009, wherein the aforesaid writ petition was dismissed for default and the interim order, passed earlier, stood vacated. Heard Mr. S. Kar Bhowmik, learned counsel for the petitioner and Mr. J. Majumder, learned counsel appearing for the state respondents.

This Court has gone through the reasons for non-appearance of the learned counsel on the date fixed. According to this Court, it would be proper to set aside the order dated 24.2.2015 passed in WP(C) No. 62/09. Accordingly, the order dated 24.2.2015 is hereby set aside and the connected writ petition being numbered as W.P(C) 62 of 2009 is restored in its original file.

CM Application is accordingly disposed of.
