Debnath, learned Addl. PP appearing for the State- respondent. This petition filed under Sections 389/401 of the Cr.P.C. is converted under Section 397(1) of the Cr.P.C. for the purpose of considering the prayer for suspending the judgment and order of conviction and sentence dated 16.10.2014 passed by the Judicial Magistrate, 1st Class, West Tripura, Agartala, Court No.4 in case No.PRC-1011 of 2010 and affirmed by the appellate court by its judgment dated 07.02.2015 delivered in Criminal appeal No.62 of 2014.

Having regard to the principles laid down in Sub-Section 3 of Section 389 of the Cr.P.C., this court finds that this is the appropriate case where the sentence can be suspended till disposal of the connected revision petition being Crl. Rev. P. No.13 of 2015. Accordingly, it is ordered that the petitioner shall be allowed to go on bail subject to furnishing of a bail bond of Rs.10,000/- (Rupees ten thousand) supported by one surety of the like amount to the satisfaction of the Judicial Magistrate, 1st Class, West Tripura, Agartala, Court No.4.
