The petitioner has been working as a Sub-Jailor in the Female Jail from the year 1997. It is the case of the petitioner that as per the Bengal Jail Code, every District Jail shall have a Jailor and Sub-Jailor. According to the Recruitment Rules of Jailor, the petitioner is entitled to get promotion to the post of Jailor from the post of Sub-Jailor. She made representation on 15.12.2014 seeking promotion with other benefits but the respondents did not dispose the representation and did not communicate anything to the petitioner. Thereafter she served a legal notice dated 05.01.2015 giving a time frame of one month to redress her grievance but the respondents did not pay any heed to the legal notice and under such compelling situation, she has filed the writ petition seeking relief as prayed for.

Hearing learned counsel of both sides, and as agreed too,it appears that the respondents may be given an opportunity to dispose the representation of the petitioner including the legal notice within a time frame and the writ petition may be disposed of after giving such a direction to the respondents.

Accordingly, it is hereby ordered that the respondents shall dispose the representation of the petitioner including legal notice within two months from today and a copy of this writ petition along with annexures should be sent to the respondents for disposal of the representation of the petitioner within the time frame and the petitioner will be at liberty to approach this Court if she is not satisfied with the action of the respondents in disposing the representation.

The representation should be disposed of with a reasoned order and the decision should be communicated to the petitioner within the time frame. Copy of this order be supplied to learned counsel of both sides for compliance. With the above observation and direction the writ petition stands disposed of. Download Date: 8-05-2017 16:05 1/1
