This is a petition under Section 389 of the Cr.P.C. for suspending the sentence as imposed by the impugned judgment and order dated 19.02.2015 delivered in case No. Special(PC Act) 01 of 2009 by the Special Judge (Sessions Judge), Gomati Judicial District, Udaipur. Mr. Das, learned counsel submits that the sentence is only of 3(three) years and in that background, Mr. Ghosh, learned P.P. for the State does not oppose the prayer in terms of Section 389(3) of the Cr.P.C.

Having regard to the nature of the sentence and the judgment, this Court is of the considered opinion that the judgment and order dated 19.02.2015 delivered in case No. Special(PC Act) 01 of 2009 by the Special Judge (Sessions Judge), Gomati Judicial District, Udaipur shall remain suspended till disposal of the appeal. Accordingly, the appellant be allowed go on bail on furnishing a bail bond of Rs.40,000/- (Rupees Forty thousand) supported by 2(two) sureties of the like amount to the satisfaction of the Special Judge (Sessions Judge), Gomati Judicial District, Udaipur.
