SAHA The instant application is filed by the applicant for allowing him to withdraw the amount of Rs.1,47,529/- as deposited by the respondents with the Registry of this Court vide cheque no. 378614, dated 12.11.2014.

Mr. Majumder submits that the applicant is in need of money and he has also filed a cross objection after receiving the notice in the appeal being LA Appeal No. 04 of 2014. Mr. Das submits that he has no objection if the applicant is allowed to withdraw the deposited money after submission of an indemnity bond. This Court has considered the contention of the applicant as made in the instant application.

It appears from the paragraph 5 of this application that the applicant has a pass-book in UCO Bank, District Court Branch, District Court, Agartala vide SB Account No. 20120110046432, MICR Code 799028004.

Considering the entire facts and circumstances, the Registry is directed to issue an Account Payee cheque in favour of the applicant i.e. the account No. mentioned in paragraph 5 after submission of indemnity bond and other formalities, as required, preferably within a period of 15 days from today.
