This is a petition under Section 5 of the Limitation Act for condoning the delay of 5 days in preferring the application for special leave to appeal against the judgment dated 25.11.2014 delivered in CR No.1608 of 2006 passed by the Addl. Chief Judicial Magistrate, West Tripura, Agartala.

Mr. D. Chakraborty, learned senior counsel appearing for the respondent No.1 and Mr. A. Ghosh, learned PP appearing for the respondent No.2 have candidly submitted that they have no opposition if the delay is condoned by this Court. Having regard to the explanation provided in the petition as well as the submission made by the learned counsel appearing for the parties, this Court is of the view that the delay of 5 days in preferring the special leave to appeal against the judgment dated 25.11.2014 delivered in CR No.1608 of 2006 passed by the Addl. Chief Judicial Magistrate, West Tripura, Agartala has to be condoned and accordingly the said delay is condoned. Accordingly, this petition stands allowed and disposed of.
