Case No :WP(C) 0000231/2012 Party Name : RAMA PRASAD DAS Vs STATE OF TRIPURA & 3 ORS. THE HONBLE MR. JUSTICE S.C.DAS No representation on behalf of the petitioners in both the cases. Learned counsel, Mr. J. Majumder for respondent Nos.1 to 3 in WP(C) No.335 of 2009 and learned Addl. G.A., Mrs. A.S. Lodh for respondent Nos.1 and 2 in WP(C) No.231 of 2012 are present.

On the last occasion i.e. on 22.06.2015 following common order was passed: "Learned counsel, Mr. D.C. Saha appearing on behalf of learned counsel of the petitioner prays for an adjournment on the ground that Mr. D. Chakraborty, learned counsel of the petitioner is ill.

Apart from Mr. D. Chakraborty there are other lawyers also engaged by the petitioner but none is present.

Records shows that on earlier five occasions also the case was fixed for hearing but on all those occasions time was sought on behalf of the petitioner. So, the prayer for adjournment is allowed as a matter of last chance on condition to pay a cost of `2,000/-(rupees two thousand) to be paid to the Lawyers' Welfare Fund of the Bar Council of Tripura and the payment should be made before the next date. It is made clear that on no ground there shall be any adjournment. List it on 22.07.2015."

Neither the cost paid as per the above order nor there is any representation today. Both the writ petitions, therefore, stand dismissed for non-prosecution. Download Date: 8-05-2017 16:05 1/1
