SAHA The instant application is filed for withdrawing the decreetal amount in pursuant to the judgment and order dated 6.1.2015 in RFA 04 of 2012 as well as the amount of Rs. 1,38,375/- which was kept in the Fixed Deposit Scheme, as per order date 2.4.2013 passed in CM Application No. 150 of 2013.

Heard Mr. KK Pal learned Counsel appearing for the applicant as well as Mr. DC Nath learned State Counsel appearing for the respondent. Mr. Nath submits that the respondents have no objection to the prayer for withdrawal as they have already deposited the entire decreetal amount with the Registry of this Court. On the other hand Mr. Pal submits that the applicant is in need of money for her survival. Thus, Registry may be directed to disburse the deposited amount in favour of her. Registry is directed to examine the matter and if the decreetal amount is deposited, then the same may be disbursed in favour of the applicant after proper identification by an Account Payee Cheque preferably within a month.
