This is an application for condoning 359 days delay in filing the writ appeal. From the application for condonation of delay it is apparent that after the impugned judgment was passed on 04.04.2014, certified copy of the order was applied for by the learned counsel and the same was also received back. It further appears that the learned counsel did not send the certified copy or any communication to the petitioner because the case of the petitioner is that he has no knowledge about the judgment. No party should suffer for the negligence of his counsel and therefore, without going into the merits in this respect we condone the delay subject to payment of Rs.5000/- (rupees five thousand) as costs. The cost be paid to the Tripura Bar Council within one month from today. Thereafter the appeal be listed for admission on 5th August, 2015.
