SAHA The instant application is filed for condoning the delay of 387 days in filing the petition for setting aside the order of abatement on the death of the sole respondent Sachindra Nath Dey and also for substitution and to add the names of the legal heirs of the sole respondent, namely, (1) Smt. Bela Rani Dey wife of late Sachindra Nath Dey (2) Sri Subrata Dey son of late Sachindra Nath Dey, (3) Smt. Anuradha Choudhury daughter of late Sachindra Nath Dey and (4) Smt. Anurupa Das daughter of late Sachindra Nath Dey, as respondents in the connected appeal being No. L.A. App. 46 of 2012 in place of the deceased sole respondent. Heard Mr. N. Majumder, learned counsel for the appellant applicants as well as Mr. T.K. Dey, learned counsel for the legal heirs of the deceased sole respondent who has no objection to the prayer for setting aside the order of abatement by way of condoning the delay.

This court has gone through the reasons for delay as explained which appear satisfactory. Accordingly, the delay in filing the petition for setting aside the order of abatement on the death of the sole respondent and for substitution of the legal heirs is condoned.
