This is a petition under Section 397(1) of the Cr.P.C. for suspending the sentence passed in the judgment and order dated 04.03.2015 delivered in Criminal Appeal No.11 of 2014 by the Sessions Judge, West Tripura, Agartala.

Having regard to the nature of the offence, this Court is of the opinion that the sentence may be suspended subject to payment of Rs.1,00,000/- (Rupees one lakh) in the Registry within a month from today.

Accordingly, the petitioner is directed to deposit a sum of Rs.1,00,000/- (Rupees one lakh) in the Registry which shall be maintained by the Registry till disposal of the connected criminal revision petition. The petitioner may be permitted to go on bail by the trial court on furnishing an undertaking that he shall deposit a sum of Rs.1,00,000/- (Rupees one lakh) within one month from today to the Registry of this High Court and he shall make himself available whenever he is asked to attend the proceeding in the High Court. Such bail should be supported by one surety of the amount of Rs.1,00,000/- (Rupees one lakh). It is made clear that if the sum of Rs.1,00,000/- (Rupees one lakh) is not deposited by 30 days from today, immediately this order shall be recalled asking the petitioner to surrender for suffering the sentence.

The Registry shall report to this Court after expiry of one month whether the petitioner had deposited the sum of Rs.1,00,000/- (Rupees one lakh) as directed. Accordingly, this petition stands disposed of. A copy of this order be furnished to Mr. S. Bhattacharjee, learned counsel appearing for the petitioner.
