A second appeal preferred by the appellant-petitioners against the judgment and decree dated 23.12.2013 passed by the learned Additional District Judge, Khowai in Title Appeal No. 04 of 2012 affirming the judgment and decree dated 07.07.2012 passed by the learned Civil Judge (Junior Division), Khowai in Title Suit No. 07 of 2010 has been admitted for hearing.

The appellant-petitioners are tenants in the suit premises and so, if they are evicted from the suit premises pending disposal of the second appeal there shall be multiplicity of the proceeding.

Having considered the contentions of the appellant-petitioners made in the petition and the grounds of objection made by the respondent-opposite parties in their written objection, I think it appropriate to stay the operation of the impugned judgment and decree passed by the Court below till final disposal of the second appeal.
