Heard learned counsel of both side.

It is submitted that respondent No.3 has also died in the meantime and she has no other legal representative except Smt. Raisona Chakraborty who is also the legal heir of respondent No.4. So, learned counsel Mr. G.S. Bhattacharjee prays for deleting the name of respondent Nos. 3 and 4 and to incorporate the name of Smt. Raisona Chakraborty in the Memo of appeal as respondent No.3.

Prayer for substitution is allowed.

Registry is directed to delete the name of respondent Nos. 3 and 4 and then incorporate the name of Smt. Raisona Chakraborty as respondent No.3 in the Memo of appeal. Thereafter notice be issued to the respondent No.3. The appellant-petitioner should take steps for service of notice on the substituted respondent No.3 within three days.
