LALIT MOHAN JAMATIA Vs THE STATE OF TRIPURA HONBLE THE CHIEF JUSTICE DEEPAK GUPTA This application for grant of bail has been filed by the applicant-petitioner Shri Rupendra Jamatia on behalf of the accused, Sri Lalit Mohan Jamatia (hereinafter called as the accused person) in respect of FIR No. 2015 BRG 014 of 2015 registered with Birganj Police Station on 12.03.2015 against the accused person under Section 448/325/506/120(b)/384 and 307 IPC. I have gone through the FIR as well as the Case Diary. In the FIR allegations are that some subscriptions were demanded by the accused person and when the victim did not give him the subscription the accused person beat up the victim. I have also perused the medical record and I find that the injuries are simple in nature.

Furthermore, I find that the accused person has been behind the bars for about 40(forty) days. The investigation is virtually completed and therefore, I direct that the accused person, Sri Lalit Mohan Jamatia be released on bail on furnishing bail bond in the sum of Rs.

(i) That, the accused person is directed not to tamper with or in any manner influence the prosecution witnesses;

(ii) That, the accused person shall ensure that no threat directly or indirectly is given to any of the prosecution witnesses;

(iii) The accused person is further directed not to cause any hindrance in the investigation;

(iv) The accused person shall not leave Tripura without permission of the appropriate Court;

(v) The accused person shall report to the Officer-in-Charge, Birganj Police Station at 10.00 am on every Saturday.

(vi) In case any complaint comes against the accused person that he is extorting money or threatening persons or tries to delay the trial, then the prosecution shall be at liberty to apply for cancellation of bail.

With these observations, the bail application is disposed of. On the applicant-petitioner filing application for supply of the copy on payment of appropriate fees, the copy of the same shall be supplied to him by tomorrow. Download Date: 8-05-2017 16:05 1/1
