SAHA In terms of the Order of this Court the Investigating Officer namely Sri Debabrata Biswas appeared before this Court and submitted that he visited the house of the accused petitioner 4 to 5 times for arresting him but the accused petitioner was not available in his house, thus he could not arrest him.

We have also perused the case diary. It appears from the case diary that he has made attempts for 4 to 5 times to arrest the accused petitioner but the accused petitioner was not available.

When the matter is taken up for bail hearing Mr. Bhattacharji, learned counsel appearing for the petitioner wants to withdraw the petition for appearing before the regular Court.
