Rukhya Begam in respect of FIR No.28 of 2015 registered against the accused at Dharmanagar Police Station under Sections 302/34 of the Indian Penal Code(IPC). The main ground raised by Mr. H.K. Bhowmik, learned counsel for the petitioner, is that even as per the case of the prosecution, all that the present accused did was that while the main accused was beating his wife the present accused stated, "Don't let her survive, kill her."

Without going into the merits of the case, I feel that in a case of this nature bail cannot be granted at this stage.

The petitioner shall be at liberty to move another bail application after the charge-sheet is filed so that the trial Court or this Court can appreciate the contentions made on the basis of the entire material collected during investigation.
