SAHA The instant application is filed for granting leave to prefer appeal against the judgment and order dated 28.01.2015 passed by the learned Sessions Judge, Gomati District, Udaipur in Crl. A 40(3)/2014 wherein the learned Sessions Judge set aside the order of conviction and sentence passed by the learned Judicial Magistrate, 1st Class, Court No. 1, Udaipur, South Tripura under Section 498A of IPC and consequent thereto acquitted the accused respondent. Heard Mr. Debnath, learned Addl. PP for the State as well as Mr. Choudhury, learned counsel for the respondent. This Court has gone through the judgment of the learned Sessions Judge, Gomati District, Udaipur as impugned in the appeal. According to this Court, this is a fit case where leave to prefer appeal should be granted. Accordingly, leave to prefer appeal is granted. In view of the above, the instant leave petition is allowed and disposed of.
