SAHA The instant application is filed by Sri Ankan Sarkar, who was the respondent in FA 68 of 1995, for allowing him to encash the FDR No. 577554 dated 15.01.2003 and FDR No. 578977 dated 10.09.2003 amounting to rupees 36,147/- and Rs. 3,080/- respectively along with interest from the UCO Bank, District Court Branch, Agartala.

Heard Mr. Dutta, learned counsel appearing for the petitioner as well as Mr. Roy, learned counsel appearing vice Mr. P. K. Pal, learned counsel for the respondents. It is stated in the petition that compensation money in the share of the petitioner, who was the respondent in FA 68 of 1995, was kept in fixed deposit as he was minor when the aforesaid amount of money was deposited. Now the aforesaid FDRs have matured and the petitioner has also attained majority and has become entitled to encash the said FDRs. Mr. Roy submits that the respondents have no objection to the prayer of the petitioner as the money belongs to him.

In view of the above, the petitioner is allowed to encash the FDRs. Registry is directed to make necessary arrangements, so that the petitioner can encash the amount deposited through FDRs, following the necessary procedure. The entire exercise shall be completed within a period of three weeks from today.

CM application is accordingly disposed of.
