By Memo. dated 12.03.2015(Annexure-1 to the writ petition) the petitioner was transferred from the Directorate of Scheduled Castes, Pt. Nehru Complex, Gurkha Basti, Agartala to District Welfare Officer, Gomati District, Udaipur. Challenging that Memo. dated 12.03.2015, the petitioner preferred a writ petition being WP(C) No.162 of 2015 and that writ petition was disposed of by an order dated 30.04.2015 directing that the petitioner may submit a representation to the respondentauthorities along with medical examination report and other papers in respect of treatment of his wife and the respondents were directed to dispose of the petition within fifteen days with a reasoned order.

Pursuant to that order, the petitioner submitted representation before his authority and the authority, i.e. the Director of Scheduled Castes Welfare, by order dated 14.05.2015 (Annexure-7 to the writ petition) disposed the representation holding that for the sake of public interest the representation of Sri Bhajan Bhowmik, LDC has been rejected after due consideration.

Now the present writ petition is again filed by the petitioner challenging the transfer order as well as order dated 14.05.2015 contending that both the orders should be set aside and the petitioner should be allowed to stay in his present place of posting for the sake of treatment of his wife.

The petitioner is working in the post of LDC and he has been transferred from Agartala to Udaipur which is only 52 KMs away. I find no mala fide in the order of transfer and also there is nothing mala fide in the impugned order dated 14.05.2015. The writ petition, is therefore, found to be devoid of any merit and hence stands dismissed. Download Date: 8-05-2017 16:05 1/1
