Bhowmik, learned counsel appearing for the petitioner as well as Mr. A. Ghosh, learned PP appearing for the State.

This is a petition under Section 407(c) of the Cr.P.C. for transferring the case No.ST/T-1 0000008/2014 (PRC 19/2014) pending in the Court of the District and Sessions Judge, North Tripura, Dharmanagar to the Court of Sessions Judge, West Tripura, Agartala. Mr. Biswas, learned senior counsel orally submits that the accused is afraid of his personal safety during the days of the trial.

Mr. Ghosh, learned PP submits that cannot be any ground for transferring the case from the Sessions division where this case has been committed for trial. However, it has been assured by Mr. Ghosh, learned PP that if the petitioner makes the communication to the Superintendent of Police, North Tripura, Dharmanagar, he shall provide necessary security to the petitioner.

Having regard to the statement made by Mr. Ghosh, learned PP, this petition stands dismissed.

Mr. Ghosh, learned PP shall send the necessary instruction to the Superintendent of Police, North Tripura, Dharmanagar so that the petitioner who is facing the trial in case No.ST/T-1 0000008/2014 (PRC 19/2014) pending in the Court of the Sessions Judge, North Tripura, Dharmanagar be provided necessary security, if the Superintendent of Police, North Tripura, Dharmanagar is approached by the petitioner. A copy of this order be furnished to Mr. Biswas, learned senior counsel as expeditiously as possible.
