JUSTICE S.TALAPATRA Heard Mr. Samarjit Bhattacharjee, learned counsel appearing for the appellant-petitioner as well as Mr. A. Ghosh, learned PP appearing for the State. This is a petition under Section 5 of the Limitation Act for condoning the delay of 899 days in preferring the connected appeal against the judgment and order dated 10.12.2012 delivered by the Sessions Judge, West Tripura, Agartala in Sessions Trial 112 of 2012 by convicting the appellant-petitioner for committing offence punishable under Section 304 of the IPC.

Mr. Ghosh, learned PP appearing for the State has raised no objection. Moreover, this Court is satisfied with the explanations made in paragraph Nos.9 and 10 and hence this petition for condoning the said delay is allowed.
