JUSTICE S.TALAPATRA Heard Mr. P.Saha, learned counsel appearing for the appellant-applicant as well as Mr. J. Debbarma, learned counsel vice Mr. A. Ghosh, learned P.P. appearing for the State. This is a petition under Section 389 of the Cr.P.C. for suspending the sentence as awarded by the order dated 18.04.2015 delivered in Criminal Appeal No.11(1) of 2013 pursuant to the judgment of conviction dated 13.04.2015 by the Addl. Sessions Judge, No.5, West Tripura, Agartala.

In pursuance to the judgment of conviction, the appellant-applicant has been sentenced under Section 471 of the I.P.C. to suffer rigorous imprisonment for 1(one) year and to pay a fine of Rs.10,000/, in default of payment of fine, to suffer further rigorous imprisonment for 2(two) months.

Having regard to the provisions of sub Section 3 of Section 389 of the Cr.P.C., this Court is of the considered opinion that this is a fit case where the sentence of the appellantapplicant shall be suspended till disposal of the connected appeal and accordingly, it is ordered.

The appellant-petitioner may remain on bail on furnishing a bail bond of Rs.10,000/- (Rupees Ten thousand) supported by 1(one) surety of the like amount to the satisfaction of the Addl. Sessions Judge, No.5, West Tripura, Agartala. It is clarified that whenever the appellant-applicant's presence is required, he shall appear before the Court, else the bail may be revoked.
