This is a petition seeking setting aside of the abatement and substituting the legal representatives of deceased respondent-O.P. Chanu Miah who died on 02.02.2010. In view of the order passed today in CM Appl. No.247 of 2015, the present petition is taken up.

Considering the submission, the prayer for substitution of the legal representatives of deceased respondent-O.P. is allowed.

Registry is directed to incorporate the names of the legal representatives of deceased respondent-O.P. Chanu Miah as per schedule of this petition in the L.A. Appeal as the respondents.

Learned counsel Mr. R. Debnath submits that he shall appear for the legal representatives of the deceased respondent-O.P. Chanu Miah and so, further notice on them is not required.
