Learned counsel Mr. Dutta has submitted that this case is fully covered by the judgment, dated 18.03.2014, passed by this Court in WP(C) 305 of 2005 along with WP(C) 306 of 2005. Learned counsel, therefore, prays for disposing the writ petition in terms of the judgment passed in the earlier writ petitions. Learned counsel Mr. J. Majumder appearing for the State-respondents has fairly admitted that the present writ petition is covered by that judgment. He has placed on record a para wise comment furnished by the concerned department of the State-respondents wherein it is stated that the respondents have no intention to deprive the petitioners from the pay scale claimed in this writ petition subject to the payment of arrears restricted to a period of 3 years prior to the date of filing of the applications made by the petitioners.

Since learned counsel of both side has agreed that the writ petitioners are entitled to the similar benefit as allowed in WP(C) No.305 of 2005 and WP(C) No. 306 of 2005 by judgment dated 18.03.2014, the present writ petition also stands disposed of in terms of the judgment passed in the earlier writ petitions i.e. WP(C) No. 305 of 2005 and WP(C) No.306 of 2005.

The petitioners shall be entitled to similar benefits as granted to those petitioners of WP(C) No.305/05 and WP(C) No. 306/05. The State-respondents shall comply the orders within 3(three) months from today.
