Bhattacharjee, learned counsel appearing for the petitioners submits that he has failed to obtain any instruction from the petitioner but it appears that by efflux of time the writ petition has become infructuous.

Mr. D. C. Nath, learned counsel appears for the State-respondents. Be that as it may, the writ petition is disposed of as infructuous but if any substantive right accrued in favour of the petitioners, the respondents shall always consider the right of the petitioners so that they are not deprived by any arbitrary action while giving the benefit of Indira Awas Yojana.
