Case No :Arb.P. 0000011/2015 Party Name : MS HORIZON HI TECH ENGICON LTD., Vs THE STATE OF TRIPURA & ORS HONBLE THE CHIEF JUSTICE DEEPAK GUPTA Sri K.L. Das, General Manager (Technical), Tripura State Electricity Corporation Limited (TSECL), Agartala, Tripura was appointed Sole Arbitrator in this case earlier vide order dated 26.11.2012. Unfortunately, the Arbitrator did not complete the proceedings though almost 3(three) years have elapsed. In between the Arbitrator has been appointed member of the Tripura Public Service Commission and, therefore, he has expressed his inability to continue with the arbitration.

Sri K.L. Das is directed to send the entire record of the case to the Registry of this Court within 15(fifteen) days from today. The Registrar General shall send a communication to him in this regard.

Keeping in view the fact that Sri K.L. Das has recused, the matter is referred to another Arbitrator.

Therefore, this Court directs that the matter be referred to the sole arbitration of Sri Sankar Deb, learned Sr. Advocate of this Court. The Registry shall handover the file which is sent to it by Sri K.L. Das to Sri Sankar Deb within one month from today and Sri Sankar Deb shall proceed from the stage where Sri K.L. Das had left the arbitration proceedings. Sri Sankar Deb, learned Sr. Counel, is requested to dispose of the matter as early as possible and shall make an effort to dispose of the matter latest by 29.02.2016. The Arbitrator shall be at liberty to fix reasonable fees for conducting the arbitration.

The parties are directed to get in touch with Sri Sankar Deb, learned Sr. Counsel, who shall fix a date for their appearance on a date mutually convenient to all. The petition is disposed of accordingly.
