Case No :WP(C) 0000271/2015 Party Name : GOPI MOHAN DEY Vs THE STATE OF TRIPURA & ORS THE HONBLE MR. JUSTICE S.C.DAS Heard learned counsel, Mr. S. B. Debnath for the petitioner and learned G.A., Mr. T. Dutta Majumder for the State-respondents.

The matter is taken up for disposal at the motion stage itself on the request of learned counsel of both side.

The case of the petitioner is that he has purchased a plot of land by registered deed dated 04.07.2012 at Mouja-Agartala, Sheet No.8 Krishnagar, Suparibagan and when he went to put boundary fencing, the neighbours were creating obstruction. Therefore, on 26.06.2013 he made an application before respondent No.2, the Deputy Collector and Magistrate, Agartala Revenue Circle, for demarcation of boundary of his purchased land, but no action has been taken as yet on his application.

Thereafter, the petitioner issued a demand notice through his engaged learned counsel to the District Magistrate & Collector, respondent No.1 and though the demand notice was received, no action has been taken as yet. The petitioner, therefore, prays for directing the respondents to take action on his petition in respect of demarcation of his purchased land. On perusal of copy of the petition dated 26.06.2013 and notice dated 08.06.2015, I find that these were received in the office of the respondents, but the respondents did not take any action on those application and notice.

The writ petition is therefore, disposed of with a direction to respondent Nos.1 and 2 to take appropriate steps on the petition for demarcation of land of the petitioner within three months from today and the petitioner is directed to submit a copy of this order along with a copy of his petition and notices to respondent Nos.1 and 2 immediately. With the above observation and direction, the writ petition stands disposed of. No costs. Download Date: 8-05-2017 16:05 1/1
