Bhattacharjee, learned counsel appearing for the appellant-applicant as well as Mr. R. C. Debnath, learned Addl. PP appearing for the State. Mr. Debnath, learned Addl. PP has fairly submitted that he would not oppose the prayer for condonation of delay.

Having regard to the reasons assigned in the petition as well as to the concession made by Mr. Debnath, learned Addl. PP, this petition is allowed. The delay is condoned granting leave to present the appeal. But again it has surfaced that for deficiency of service of the legal aid counsel substantial part of the delay has occurred.

The High Court Legal Services Committee shall consider the conduct of the Counsel while assigning any case in future, particularly when the appeals are to be made from the jail. This petition is accordingly disposed of.
