Case No :CMAppl(FA) 0000286/2015 Party Name : GLOBAL EDUCATION NET & ORS Vs THE STATE OF TRIPURA & ORS HONBLE THE CHIEF JUSTICE DEEPAK GUPTA An agreement was entered into between the two parties on 7th October, 2004 and as per Clause 5 of the said agreement all disputes and differences arising between the parties were to be referred to arbitration. Each of the parties was authorized to appoint an arbitrator of its choice.
The petitioner-herein M/S Global Educational Net approached this Court for appointment of Arbitrator and in Arbitration Petition 01 of 2014 decided on 20th June, 2014, this Court had appointed Justice(Rtd.)Amit Talukder, retired Judge of the Calcutta High Court as soleArbitrator. Sri Talukder has sent a communication that he has been appointed Chairman of the West Bengal Administrative Tribunal and therefore he cannot continue with the Arbitration. The parties have agreed that the matter be now be referred to the sole-Arbitrator, Justice Raghunath Ray (Rtd.), Tower 3 Plot 2, E3 Eastern High, Action Area 1 New Town Plot, AGI Major Arterial Road, New Town Rajarhat, Kolkata 700156, Phone Nos. - 9674156313/03323241043, a retired Judge of the Calcutta High Court. I have been informed by learned counsel for the petitioner that Justice Ray is agreeable to be appointed as Arbitrator.
He is accordingly appointed as Arbitrator to decide the dispute between the parties. The learned Arbitrator is requested to fix reasonable fees in the matter. The Registrar General is also directed to send a communication to Justice (Rtd.) Amit Talukdar who may be requested to handover the record of the proceedings which took place before him directly to Justice Raghunath Ray at the address given up. The party shall also be at liberty to send a copy of this order to Justice (Rtd.) Amit Talukdar so that he is informed about the same. The learned Arbitrator is requested to continue with the proceeding from the stage where Justice Talukdar left the proceedings.
