Learned senior counsel, Mr. Bhowmik submits that charge sheet has been filed in this case but the petitioner's name has not been reflected in the charge sheet and so it is to be presumed that the petitioner is not involved in the allegation and therefore learned senior counsel prays for bail of the accused.

Learned Addl. P.P., Mr. Debnath, on the other hand, submits that in connection with this case number of accused persons are involved and so I.O. after concluding investigation submitted charge sheet in part as against some of the accused persons and investigation against the accused-petitioner, Mita Malakar is still continuing and charge sheet has not yet been filed against accused, Mita Malakar.

On perusal of the records I find that on earlier two occasions this accused approached this Court for grant of anticipatory bail and on all those occasions the bail applications were rejected after perusing the case diary and other materials but yet the accused did not surrender and evading arrest and again has come before this Court after so many month praying for pre-arrest bail.
