This is an application for condonation of 173 days delay in filing the appeal. Earlier the averments made were vague and, therefore, this Court had directed the insurance company to file a detailed affidavit in support of its allegations. This affidavit has been filed and now date wise details have been given with regard to the manner in which the file was dealt with at previous offices.

No doubt, there is inordinate delay in dealing with the files and the insurance company has not dealt with the files with the urgency the matter required. However, this Court cannot lose sight of the fact that the insurance companies are also Public Sector Undertakings and public money is involved. Appeals arising out of similar awards out of the same accident have already been admitted. Therefore, I feel in the present case also the delay should be condoned. Accordingly, the delay in filing the appeal is condoned. CM application is disposed of.
