SAHA The instant application is filed by the convict appellant-petitioner for suspension of the sentence dated 28.07.2015 passed by the learned Addl. Sessions Judge, Unokoti Judicial District, Kamalpur, in Case No. ST 21(NT/KMP) of 2015, wherein, the petitioner was convicted under Section 354 of the IPC and sentenced him to suffer RI for 1 year and to pay a fine of Rs. 10,000/-, in default to suffer further RI for three months. Heard Mr. D. Dutta, learned counsel appearing for the appellant petitioner and Mr. R. C. Debnath, learned Addl. P.P. appearing for the State respondent. This Court has gone through the impugned judgment, which is under challenge in Crl. App. No. 18 of 2015. According to this Court, this is a fit case where the sentence should be suspended.
Accordingly, the order of sentence dated 28.07.2015, passed by the learned Addl. Sessions Judge, Unokoti Judicial District, Kamalpur, in the aforesaid sessions trial, is suspended till the appeal is disposed of.
The appellant convict petitioner shall be enlarged on bail on furnishing a bail bond of Rs. 10,000/- with one surety of the like amount to the satisfaction of the learned Trial Court, i.e. the learned Addl.
