Case No :AB 0000076/2015 Party Name : CHIKAN MALA TRIPURA Vs THE STATE OF TRIPURA HONBLE THE CHIEF JUSTICE DEEPAK GUPTA Earlier an anticipatory bail application filed by the applicant, Smt. Chikan Mala Tripura was rejected on 12.08.2015. Fresh bail application can only be filed if there is changed circumstance. The only changed circumstance is that according to the applicant the other co-accused was released on bail on 10.06.2015. This circumstance was existing on 12.08.2015 and it is not a changed circumstance. Merely, because the other co-accused has been granted bail does not mean that the custodial interrogation of the applicant is not required.

In the order dated 12.08.2015 in AB No.72 of 2015 this Court has already given reasons for rejecting the bail application. There is no mean to give fresh reasons. In fact, it is surprising that despite the rejection of the bail application, the applicant has not been arrested and a fresh application has been filed. It appears that the Investigating Officer is not interested in arresting the applicant.

A copy of this order shall be sent to the Superintendent of Police, South Tripura district who shall verify why the applicant was not arrested. Application is dismissed.
