JUSTICE S.TALAPATRA Since the sole petitioner died during pendency, her legal heirs have filed this application for their substitution as the cause exposed in the writ petition survives even after the death of the sole original petitioner.

Mr. S. Chakraborty, learned Addl. Govt. Advocate appearing for the state did not raise any objection. However, there is no representation for the respondent No.3 when the matter is taken up.

As there is no dispute regarding the legal heirs of the original writ petitioner who had filed the stay petition, being C.M.Appl. No.174/2015, arising from the writ petition, being W.P.(C) No.202/2015, this court is inclined to allow this application on allowing the substitution of the petitioners in the application, being C.M.Appl. No.174/2015. The Registry is directed to score out the name of the original petitioner and in her place insert the name of the petitioners in the application, being C.M.Appl.
