Roy Barman at the bar submits that Ms. R. Guha, who is the engaged counsel, is not present in the court and, therefore, he has submitted that the matter may be listed on another day.

The Interlocutory Application was first taken up on 01.09.2015 and thereafter it was listed on 04.09.2015. On 04.09.2015 there was no representation on behalf of the petitioner. It was clearly stipulated in the order passed on that day that the matter should be listed on 23.09.2015 and if there is no representation on behalf of the petitioner on that day the petition would be dismissed.

In view of the specific order passed on the last day and since there is still no representation on behalf of the petitioner, I find no justification at all to keep it pending and accordingly, the petition stands dismissed for non-prosecution. Download Date: 8-05-2017 16:05 1/1
