&56%&57 - The petitioner, by means of this writ petition, has prayed thatshebealsocalledforthirdcounselingtobeheldon9thSeptember, 2015intheTripuraMedicalCollegeandDr.BRAMTeachingHospital.  Theundisputedfactsarethatthereare25seatsearmarked for Scheduled Tribe candidates in the Tripura Medical College and Dr. BRAM Teaching Hospital. It is not disputed that there are 13 eligible Scheduled Tribe candidates and 13 seats have been filled up. Two candidates, namely Miss Cynthia Chakma and Miss Mourima Debbarma, the respondent Nos.7 and 8, bearing Roll Nos.1001 and 1179 have no doubtpassedtheadmissiontestbuttheyhavenotclearedthequalifying testandhadobtainedcompartmentinthequalifyingexamination. However, these two candidates have also been called for third counseling. Since these two candidates have been called for third counselingon9thSeptember,2015,incasethesetwocandidatesfailto produceanyproofthattheyhavepassedthequalifyingexaminationthen nofurtheropportunityshallbegrantedtothemandtheirseatsshallbe treatedtobevacatedandshallbefilledupfromamongsttheunreserved candidatesasperthejudgmentofthisCourtinW.P.(C)No.244of2015

On 9th September, 2015 if these two candidates do not produceanyproofoftheirhavingpassedthequalifyingexamination,then thesetwoseatswillautomaticallybeconvertedtotheURcategories.  Itisstatedthatatpresentthereareonlyfourseatsvacant, twointheURcategoryandtwowhichwereearmarkedforthecandidates bearingRollNos.1001and1179andiftheydonotappearthenthesetwo seatswillalsogototheURcategoryandtherewouldbefourseatsinthe URcategory.Inadditiontothesetwocandidates,eightcandidateshave beencalledforthirdcounselingagainstthefourseatsatthemostwhich mayfallvacant.  The petitioner prays that she may also be called for the third counseling. All the eight candidates called for counseling have obtained62%markswhereasthepetitionerhasobtained61%marks.We cannotexpandthescopeatthisstageand,therefore,thecounselingmay continueasproposedon7thSeptember,2015.Wewould,however,liketo give certain further directions. In case, after third counseling also, any seatsremainsvacantintheTripuraDomiciledCandidateGroup,thenthe persons next in the merit list, shall be called for counseling. We also further direct that if the seats on all India basis are not filled in, then counselingforthoseshallbeheldasperorderoftheSupremeCourttill 30thSeptember,2015andifnocandidatesareavailable,thenthoseseats shallalsobeofferedtoURcandidatesafter30thSeptember,2015.
